Drug Trafficking Defense in Murrieta

Drug Trafficking Defense Grounded in the Evidence

Drug trafficking allegations call for a close examination of the substance, alleged transportation, claimed purpose, and law enforcement conduct. At John Pozza Attorney At Law, PLC, we build the defense around the specific allegations and evidence rather than treating every drug case alike. Attorney John Pozza has more than 30 years of experience and has protected the rights of thousands of adults and juveniles facing serious drug charges throughout the region.

Our criminal defense practice was founded in 1994. We represent clients accused of controlled-substance offenses at both the felony and misdemeanor levels.

Our drug-crimes representation includes:

  • Drug possession
  • Drug trafficking
  • Intent to sell
  • Drug manufacturing
  • Crack and cocaine offenses
  • Heroin and other opiate offenses
  • Ketamine offenses

How California Distinguishes Trafficking from Possession

Simple possession generally concerns a controlled substance allegedly held for the accused’s own use. A possession-for-sale allegation claims that the substance was intended for distribution. Prosecutors may cite quantity, packaging, communications, money, or other circumstances as evidence that the possession was connected to sales.

Drug trafficking covers conduct allegedly connected to selling, furnishing, administering, giving away, importing, or transporting controlled substances for sale. California Health and Safety Code section 11352(a) doesn’t treat every movement of a controlled substance as transportation for sale. Under that theory, the prosecution must prove that the transportation was for sale rather than personal use.

The alleged purpose of the transportation can therefore become a central issue. The amount and type of substance matter, but they aren’t the only evidence that may shape how the allegations are evaluated.

California Drug Trafficking Penalties

California Health and Safety Code section 11352(a) provides a felony sentencing range of three, four, or five years. Where that term is served can depend on California sentencing rules and the defendant’s circumstances. A conviction can also carry a fine of up to $20,000 in addition to custody time.

Different sentencing exposure may apply when the alleged transportation crosses into a noncontiguous county. The statutory range for that conduct is three, six, or nine years. The charge, criminal history, factual findings, and applicable sentencing provisions can affect the punishment in an individual case.

Drug quantity enhancements can add consecutive time to the underlying sentence. Under Health and Safety Code section 11370.4, specified large quantities of cocaine, cocaine base, or heroin may trigger enhancements beginning at three years for more than one kilogram. The enhancement increases at higher weight levels and can reach 25 years for more than 80 kilograms of a specified substance.

These ranges are general legal information, not a prediction about a particular case. Possible state prison sentencing or other custody exposure depends on the charged statute and proven facts, including the substance, quantity, and prior record.

When Drug Trafficking Allegations Become Federal

A drug arrest in Murrieta doesn’t automatically result in federal prosecution. Federal authorities may become involved when allegations concern large quantities, interstate transportation, organized distribution networks, or international operations. The investigating agencies and facts of the alleged conduct can influence whether charges remain in state court or proceed in federal court.

Under 21 U.S.C. section 841(b), federal penalties depend heavily on drug type and quantity. Specified threshold quantities can carry mandatory minimum sentences of five or 10 years. A qualifying prior serious drug felony or serious violent felony can increase a 10-year mandatory minimum to 15 years, while two or more qualifying convictions can increase that minimum to 25 years under current federal law.

Reviewing the Evidence Behind a Trafficking Charge

Our drug trafficking defense in Murrieta begins with the allegations and circumstances of the investigation. We examine the prosecution’s account of the substance, its location and control, and the evidence it cites as proof of intent to sell. Our understanding of prosecution tactics helps us identify the factual and legal issues that deserve focused attention.

We also inspect each aspect of the case for potential Fourth Amendment violations. The Fourth Amendment protects people against unreasonable government searches and seizures. Depending on the facts, the defense may question the legal basis for a vehicle stop, the scope of a search, the seizure of property, or the circumstances of an arrest.

A search issue doesn’t arise in every case, and its presence doesn’t predetermine the result. We review whether officers had a warrant, whether they claimed an exception to the warrant rule, and whether the search remained within lawful limits. The location of the substance and the evidence connecting it to the accused can also affect the issues presented.

For a transportation-for-sale allegation, we examine the claimed purpose of the movement. Evidence about the substance’s movement, packaging, and surrounding communications may bear on whether the prosecution can prove transportation for sale. Throughout that evaluation, we proceed from the principle that every accused person is presumed innocent unless the prosecution proves guilt beyond a reasonable doubt.

What Follows a Drug Trafficking Arrest in Murrieta

Criminal matters arising in Murrieta may be heard at the Southwest Justice Center, which handles criminal, traffic, and juvenile matters. The first court hearing is the arraignment, where the charges are addressed and a plea is entered.

After arraignment, a case can proceed through evidence exchange, investigation, pretrial motions, negotiations, or trial. Motions may address legal questions such as the admissibility of evidence or an alleged search and seizure violation. The allegations, evidence, legal disputes, and court proceedings shape the timeline of each case.
